Attorney Josh Bovender Holds Lancaster Jury to $1.00 Verdict in Admitted-Liability, Traumatic Brain Injury Case

TT&H Attorney Josh Bovender recently prevailed at trial in Lancaster County in an action involving alleged traumatic brain injury.
In the suit, it was claimed that Josh’s client operated a fully-loaded pick-up truck and trailer. He collided with Plaintiff’s vehicle causing extensive damage to the vehicle and allegedly injuring two of its three occupants, including the Plaintiff. Prior to trial, the Plaintiff demanded $250,000.00, the limits of Josh’s client’s liability coverage.
After the demand was refused, the matter proceeded to trial. While negligence and causation were admitted, Josh’s defense focused on Plaintiff’s recovery timeline, underscoring her extensive vacations immediately after the accident.
After deliberating for less than two hours, the jury returned the nominal verdict of just $1.00. Commenting on the verdict following trial, Josh stated: “We are very pleased with the jury’s result. The verdict sends a clear message that common sense is alive and well in this jurisdiction.”
