Attorney Mike Burgoyne Wins Favorable Damages Verdict in Action Arising From an Oil Spill

TT&H Attorney Mike Burgoyne recently won a favorable damages verdict in the Circuit Court for Carroll County, Maryland. The action arose out of the replacement of an oil-fired boiler at the Plaintiff’s home.
The Plaintiff alleged that Mike’s client negligently installed the boiler, and while removing the boiler caused 25 gallons of residential fuel to spill oil onto the Plaintiff’s lawn, resulting in contamination of the ground water. The Plaintiff maintained counts of negligence, breach of contract, nuisance, trespass, and Violation of the Maryland Consumer Protection Act. He sought $53,000.00 in economic damages, approximately $150,000 for noneconomic damages, and approximately $30,000.00 in attorney’s fees.
After a one-week trial, however, the jury returned a verdict of just $10,000.00.
