TT&H Attorney Daniel Grill Prevails in Medical Malpractice Case in Lancaster County, Pennsylvania

TT&H Attorney Dan Grill recently won a defense verdict in a medical malpractice case tried in Lancaster County, Pennsylvania. Plaintiff’s decedent had multiple visits to the emergency room at Ephrata Community Hospital. Ultimately, a blood clot was identified and had caused damage to the point that the patient underwent four surgeries, the third of which was a below-the-knee amputation, and the last of which was an above-the-knee amputation. TT&H’s client was a radiologist who had been involved at the emergency department visit ten days prior to a diagnosis of the blood clot. He was responsible for interpreting an arterial ultrasound, and he and the sonographer who conducted the study both concluded that there was blood flow to the right foot, which precisely answered the question posed to the radiology department by the emergency department physicians.
The Plaintiff argued, through multiple expert witnesses, that the blood clot was present at the time of the client’s arterial ultrasound and, in fact, was present for several weeks leading up to that point. One of the defense themes was that the patient was in no acute distress and there was no emergent situation or indication for surgery. The patient suffered from chronic circulation problems for which the standard of care is to be managed in the primary care environment, and not in the emergency room. The patient failed to follow-up outside the hospital despite being advised to do so multiple times.
After five days of trial the jury of twelve returned a finding of “no negligence” for all Defendants, including the radiologist Dan represented.
