TT&H Attorney Joshua Bovender Saves Commercial Client from Financial Ruin by Securing Settlement of EPA Clean Air Act Claims

Joshua Bovender, a partner in our Camp Hill office, successfully negotiated the settlement of thirty-seven separate Clean Air Act violations asserted against Josh’s client by the Environmental Protection Agency.  Josh’s client is a growing, well-known Pennsylvania business, and was alleged to have installed “defeat devices” in numerous motor vehicles.

After twelve months of disputing the matter with the EPA, Josh was able to secure a settlement at a fraction of the originally-alleged fines and related violations.  While Josh’s client denied wrongdoing, the full effect of the fines, if enforced to the statutory limit, would have put the company out of business.

The settlement preserved the integrity of the client’s business, allowing the company to continue to grow and thrive.
