TT&H Attorneys Katelynn Storm and Adam Kleiber Contribute to the Fall 2023 PAMIC Pulse

TT&H’s Katelynn Storm, an attorney in the firm’s Philadelphia office, authored “The Proliferation of Private Litigation Funding” for the Fall 2023 edition of PAMIC Pulse. Katelynn’s article focuses on the rapid recent growth of private litigation funding in Pennsylvania and the country at large. The basic idea behind private litigation funding is simple enough: an unrelated company agrees to finance a plaintiff’s lawsuit expenses (or their living expenses during the course of the suit) in exchange for a percentage of their eventual settlement or award. Opinion is split over whether this development is positive – allowing underfunded plaintiffs to take on large corporations – or negative – featuring an unregulated community of large companies taking advantage of litigants. However, private litigation funding’s most practical effect for PAMIC readers is less willingness on the part of plaintiffs to settle, as they have more capital funding their expenses and a looming threat of losing a percentage of any gain.
Also contributing to the Fall 2023 edition of PAMIC’s magazine was Adam Kleiber, an attorney in the firm’s Camp Hill, PA office. Adam authored an article entitled: “United States Supreme Court Emboldens Forum Shopping in Recent Mallory v. Norfolk Southern Decision.” As the title suggests, in Adam’s article, he addresses the Supreme Court’s recent holding in Mallory v. Norfolk Southern. In that case, the Court upheld a Pennsylvania statute requiring out-of-state corporations to consent to jurisdiction in Pennsylvania courts as a prerequisite for doing business in Pennsylvania. Adam discussed the potential implications of the Court’s holding on corporate defendants (and their insurers) that are registered to do business in Pennsylvania, specifically addressing concerns related to jurisdiction and venue.
