Lucas Duty Wins Defense Verdict in Baltimore County Automobile Negligence Case
December 20, 2023
TT&H Attorney Lucas Duty recently won a defense verdict in the District Court for Baltimore County. The case concerned an auto accident on Interstate 695. Plaintiff alleged that the Defendant-driver rear-ended his vehicle in the far left lane, while the Defendant alleged that the Plaintiff, without looking, merged into the front of the Defendant’s vehicle. In his suit, the Plaintiff sought $25,000.00 in damages, claiming negligence on the part of Lucas’ client.
The matter proceeded to a bench trial, which took place on December 15, 2023. During cross examination, the Plaintiff reiterated his claim that the collision occurred while Plaintiff was fully in the left lane, with the Defendant directly hitting the rear of the Plaintiff’s vehicle. Photos of the damage to both vehicles showed damage only to the rear driver side of the Plaintiff’s vehicle and the front passenger side of the Defendant’s vehicle. At the conclusion of the bench trial, Lucas successfully argued that the damage to both vehicles showed that the Plaintiff’s vehicle suddenly merged into the front of the Defendant’s vehicle. Based on the parties’ testimony and the evidence submitted, the Court found the Defendant’s testimony to be more credible and entered judgment in favor of Lucas’ client.
