TT&H Attorney Briana Vetter Wins Defense Verdict in Connection with Philadelphia Arbitration

TT&H Attorney Briana Vetter recently received a defense verdict in the Philadelphia County Court of Common Pleas compulsory arbitration program. The matter, which began its life in the Major Jury Program, involved an alleged trip and fall on a Philadelphia sidewalk. Briana represented a construction company that allegedly a caused a defect in the sidewalk, which was adjacent to the Plaintiff’s home. The Plaintiff alleged permanent injuries and initially demanded $395,000.00.
After successfully petitioning the Court to remand this matter to the arbitration program, Briana navigated a number of complicated issues, including a third party joinder beyond the statute of limitations, claims of contractual indemnification and contribution, and defenses based upon governmental immunity. At arbitration, Briana convinced the panel that Plaintiff had substantial notice of the construction occurring outside of his home. Additionally, she argued that that Plaintiff’s claimed injuries did not align with the alleged mechanics of the fall. Agreeing with Briana, the arbitration panel found in favor of all Defendants and against the Plaintiff.
