Attorney Joe Shields Wins Defense Award for Local Utility

Joe Shields, an attorney in TTH’s Wilkes-Barre office, recently won a defense award for a local utility.  The award followed an arbitration held in Luzerne County.  The suit was premised upon breach of contract.  The Plaintiff claimed that he paid for fire protection water services at his property for approximately two and half years, but the Defendant utility never activated the service.

The Plaintiff sought reimbursement for all payments made during that time period, as well as pre-judgment interest.  After brief deliberation, the arbitration panel, comprised of three Luzerne County attorneys, issued a unanimous award fully in favor of the Defendant utility.  The panel concluded that the Plaintiff failed to substantiate his allegations, thus warranting the award in favor of Joe and his client.
