Attorney Joshua Bovender Prevails in Contract Action Following a Four-Day Trial

TT&H Attorney Joshua Bovender, a partner in the firm’s Camp Hill office, recently won a $268,440 jury verdict in favor of his clients.  The verdict came on the heels of a four-day trial in Dauphin County, Pennsylvania.

The commercial matter involved a hybrid triple net lease and construction contract, with a project value of $350,000.  Josh’s clients brought their claims after the Defendant, a national retailer, refused to adequately complete the project in a good and workmanlike manner.  The Defendant also failed to honor the NNN obligations of the lease for several substantial timeframes, contending instead that it was owed credits and offsets which negated the claims asserted against it.  Rejecting the Defendant’s position, the jury returned a verdict in favor of Josh’s clients after three and half hours of deliberation.
