Attorney Joshua Bovender Secures a Half-Million Dollar Judgment in a Trade Secrets and Commercial Contract Case

TT&H Attorney Josh Bovender recently represented an engineering firm in connection with a dispute among three national companies. The matter stemmed from the Defendants’ alleged theft of intellectual property and breached contracts for the assembly of waste water treatment equipment. Josh’s client, a multi-national engineering firm who specializes in the design of highly-valuable equipment, suffered serious damages when a Wisconsin-based company refused to perform under the parties’ contract, improperly assembled equipment, and attempted to hold Josh’s client’s trade secrets for ransom.
After protracted litigation over personal jurisdiction, the Pennsylvania Court ruled in Josh’s favor and found that the offending Defendant was subject to jurisdiction in Pennsylvania. Thereafter, the responsible party was unable to respond to the overwhelming claims against it, and the Court entered judgment in favor of Josh’s client for over $506,000.00. As Josh stated: “While we are still pursuing the responsible parties in other forums, this result affirms our long-held belief that any party that harms our clients should be subject to jurisdiction here, regardless of where they’re from.” Josh added: “I look forward to equally-successful results in our remaining venues where this dispute is being heard.”
