Attorney Joshua Bovender Wins Auto Negligence Trial After Jury Deliberates for Less Than 20 Minutes

Attorney Joshua Bovender, a partner in the firm’s Harrisburg office, recently obtained a defense verdict following a jury trial in Chester County. This is the second trial in the past year where Josh’s jury returned with a defense verdict in under 20 minutes. The case involved a classic “he said, she said” auto accident.
Plaintiff alleged that Josh’s client backed into his vehicle while exiting her (Defendant’s) driveway. Josh’s client wholeheartedly denied the allegation, while contending that the Plaintiff collided with her car while she was pulling into her driveway. Plaintiff, an Air Force veteran, alleged multiple traumatic injuries to his bilateral knees and wrist, necessitating five separate surgeries. Josh’s trial witnesses included an accident reconstruction expert who recreated the entire crash sequence for the jury. Over Plaintiff’s objections, Josh was also able to admit the favorable testimony of the investigating State Police Trooper.
Following the jury’s decision in Josh’s favor, he commented: “We are always mindful of attempting to resolve cases without the need for trial, but sometimes, a jury needs to decide. This was one of those. Our client was an excellent witness, and we thank her, the jury, and the Court for hearing the case and rendering a fair verdict on the evidence.”
