Thomas, Thomas & Hafer Attorney Michael Moran Wins Philadelphia County Arbitration

TT&H Attorney Michael Moran was victorious in an arbitration hearing in Philadelphia County. The Plaintiff sued Michael’s client, a cremation facility, alleging, among other things, that the Defendant facility failed to complete and submit paperwork that would have entitled the Plaintiff to rebates, credits and benefits on behalf of his deceased mother.
The arbitration included some peculiar circumstances, with the Plaintiff invoking his 5th amendment right against self-incrimination and refusing to answer any questions on cross-examination. In addition, despite appearing via Zoom, the Plaintiff examined Michael’s client for some two hours, including multiple instances in which a member of the panel assisted Plaintiff in the examination. Even without Plaintiff’s testimony, Michael was able to demonstrate that the Plaintiff proffered no evidence of defamatory speech made against him. Michael also demonstrated Plaintiff’s blatant lack of evidence to support any claim that the Defendant engaged in deceptive business practices. The Arbitration Panel ultimately ruled in Michael’s favor, entering an award in favor of his client.
