Thomas, Thomas & Hafer Attorney Nick Phillips Wins Dismissal of Personal Injury Action

TT&H Attorney Nick Phillips, a partner in the firm’s Fairfax, VA office, recently won the dismissal of a $1 million personal injury case arising out of a construction site accident.  Nick represented a subcontractor that installed a window-well egress grate in connection with the construction of a residential property.  The Plaintiff, an employee of another subcontractor, claimed that Nick’s client negligently installed the grate, causing the Plaintiff’s injury.

The Trial Court agreed with Nick’s argument that the Plaintiff had no right to sue because his exclusive remedy was payment of benefits under the Virginia Workers’ Compensation Act.
