TT&H Attorney Andrew White Wins Defense Verdict in the District Court for Baltimore City in a Motor Vehicle Accident Case

TT&H Attorney Andrew White recently won a defense verdict in a motor vehicle accident case following a bench trial held on August 29, 2022, in the District Court of Maryland for Baltimore City. Plaintiff alleged that the Defendant driver was negligent when his vehicle crossed over a double yellow line and struck the Plaintiff’s vehicle, resulting in personal injuries to the Plaintiff.
At trial, testimony from Andrew’s client demonstrated that the driver’s side tires of Defendant’s vehicle crossed the yellow line because he had to avoid vehicles which were parked along the right side of the roadway. In addition, testimony from Andrew’s client and an independent witness further demonstrated that it was Plaintiff who struck Defendant’s vehicle while Plaintiff was in the process of exiting a gas station parking lot. The testimony of Andrew’s client revealed that Plaintiff did not look both ways before exiting the parking lot. The District Court found that the Defendant driver was not negligent in crossing the double yellow line because there was an obstruction in the roadway. In addition, the District Court found that Plaintiff failed to exercise reasonable care, and failed to yield the right of way to vehicles in the roadway while exiting the parking lot. The Court thus entered judgment in favor of Andrew’s client.
