TT&H Attorney Greg Kunkle Wins Defense Verdict in Essex County, New Jersey

TT&H Attorney Greg Kunkle recently won a defense verdict in the Essex County Superior Court in Newark, New Jersey.  Greg defended a limited liability company-property owner, which was alleged to have been at fault for an injury that occurred to a laborer for a contractor on the property.  The contractor had been retained to perform building renovation and construction, and the Plaintiff incurred injury when he fell from a ladder.

Plaintiff attempted to impose liability by arguing that the Defendant-property owner acted as a de facto general contractor and was subject to OSHA regulations.  Greg’ s defense strenuously refuted that characterization of the owner and the supposed applicability (and violation) of any such OSHA duties.  Following a week-long trial, the jury found no causal negligence attributable to the property owner and, thus, returned a defense verdict.
