TT&H Attorney Jack Lapidus Wins Defense Verdict in Connection with a Prince George’s County Jury Trial

In connection with a case defended by TT&H Attorney Jack Lapidus, a Prince George’s County Circuit Court jury recently entered a verdict for the Defendant. The matter involved claims of personal injury arising from a multi-vehicle motor vehicle accident that occurred on May 11, 2018. The parties disputed whether Plaintiff had completed a lane change or was still in the process of changing lanes when the accident happened. Complicating the claim was the fact that about two weeks later, Plaintiff was in a second accident. Prior to the second accident, Plaintiff had only one medical visit and missed three days from work. By the time of the second accident, Plaintiff had returned to his regular, full time duties and agreed his symptoms had been improving. After the second accident, Plaintiff reported new and substantially worsened symptoms. The subsequent issues included the need for a future discectomy. Plaintiff attributed all of his injuries to both accidents.
At trial, both liability and damages were heavily contested. The matter was decided in favor of the Defendant on the issue of liability, with the jury finding that Plaintiff was contributorily negligent, thereby barring him from recovery.
