TT&H Attorney Joe Cardile wins summary judgment in Baltimore City action claiming fractured knee cap and other serious injuries.

In connection with a suit claiming sidewalk defects, Attorney Joe Cardile recently won summary judgment on behalf of a construction company. The incident occurred in Baltimore City, Maryland and resulted in significant injuries, including a fractured knee cap. The Plaintiff had been walking her dog at night when she tripped and fell on a handicap sidewalk owned by the City. The Plaintiff alleged negligence and premises liability. Her civil engineer maintained that the sidewalk was installed defectively and in violation of Baltimore City Code. Representing the construction company that installed the sidewalk, Attorney Cardile sought summary judgment, arguing that the sidewalk was merely a replacement, in identical form, of a previously existing sidewalk and curb.
Agreeing with Attorney Cardile, the Court entered summary judgment in favor of the construction company. The Court recognized that Joe’s client merely replaced an allegedly defective preexisting condition, and had no duty to correct that condition as part of its work in removing and reinstalling the sidewalk.
