TT&H Attorney John Lucy Wins Luzerne County Medical Malpractice Case

TT&H Attorney John Lucy recently achieved a unanimous defense verdict in a medical malpractice case tried in Luzerne County, Pennsylvania. Plaintiff, then 9 years old, presented to a local hospital in April of 2011 with complaints of testicular pain. Several months later, Plaintiff underwent an orchiectomy to remove the affected testicle. Plaintiff alleged that the hospital, emergency department physician, two radiologists, and a urologist, were negligent in failing to timely and properly diagnose testicular torsion, a urologic emergency which requires immediate surgery. Attorney Lucy successfully argued that his client, one of the radiologists, appropriately reviewed and assessed the initial doppler ultrasound, which demonstrated both adequate and symmetric perfusion. The ultimate diagnosis of infection, and recommendation for discharge with continued follow-up, was therefore appropriate and met the standard of care.
Plaintiff’s most recent demand prior to trial was $2.8 million. No offer was made on behalf of Attorney Lucy’s client. The Co-Defendant radiologist and urologist were dismissed by non-suit at the close of Plaintiff’s case. The remaining Defendants, to include the hospital and the emergency room physician, received defense verdicts as well.
