TT&H Attorney Logan Nagle Wins Defense Verdict in Montgomery County Motor Vehicle Accident Case

TT&H Attorney Logan Nagle recently won a defense verdict following a two-day jury trial in Montgomery County. The jury deliberated for just over twenty minutes before finding that the motor vehicle accident at issue was not a factual cause of the Plaintiff’s alleged harm. The case involved a Plaintiff who had a considerable history of prior and subsequent accidents with identical injuries.
The subject case was brought by the passenger of a vehicle stopped at a traffic light. Logan’s client was stopped approximately five feet behind the Plaintiff when her foot momentarily slipped off the brake pedal. The two vehicles came into contact with one another before the latter vehicle was brought to a stop. All parties denied injuries and medical attention on site. Defendant, the other driver, and the responding police office, all testified to the minor nature of the impact, the lack of force involved, and the lack of damage to the involved vehicles. The Plaintiff also admitted to three prior accidents and three subsequent accidents, including one within mere weeks of the subject accident. After the Court ordered a directed verdict on the question of negligence, the jury deliberated for twenty-four minutes before finding that Defendant’s negligence was not a factual cause of the alleged harm.
