TT&H Attorney Rebecca Sember-Izsak Wins Appeal, Affirming the Trial Court’s Dismissal of Plaintiff’s Complaint

On March 15, 2021, the Pennsylvania Superior Court issued a published opinion affirming the dismissal of a wrongful death professional negligence action. The suit claimed that Plaintiff’s decedent died on April 19, 2015 as a result of “combined drug poisoning.” The Plaintiff had filed Writs of Summons against various Defendants in April 2017, but service was not effectuated until April 2019. Representing one of the several Defendants, TT&H Attorney Rebecca Sember-Izsak filed Preliminary Objections based upon the statute of limitations and the Plaintiff’s failure to make a good faith attempt to serve the Writs after filing the same. After the Trial Court sustained the Preliminary Objections and dismissed the action, the decision was more recently affirmed on appeal by the Pennsylvania Superior Court.
