TT&H Attorneys Eric Appelbaum and Chris Gallagher win summary judgment in Philadelphia County trip and fall case.

Eric Appelbaum and Chris Gallagher, attorneys in TT&H’s Philadelphia office, recently won summary judgment in connection with a trip and fall incident outside of a restaurant in Philadelphia.  The Plaintiff allegedly tripped when her foot got caught in a sidewalk crack as she was moving backwards, fleeing from an alleged assailant.  Eric and Chris were able to establish through discovery that their client did not have possession of the property and was not responsible for the maintenance of the sidewalk.  The Court agreed.  Finding that TT&H’s client owed no legal duty of care to the Plaintiff, the Court granted Eric and Chris’ Motion for summary judgment.  Notably, the Plaintiff’s demand for settlement prior to the Court’s ruling was for the sum of $395,000.00.
