TT&H Attorneys James Dodd-o and Paraskevoula (“Voula”) Mamounas Win Summary Judgment in a Lehigh County Construction Accident Case

Representing a general contractor sued in the Lehigh County Court of Common Pleas, TT&H Attorneys James Dodd-o and Voula Mamounas recently won summary judgment. The suit was filed by a demolition worker who claimed injuries after being struck by a loose brick that fell from an elevation above where he was working. The Plaintiff was employed by a subcontractor hired by the general contractor. He alleged that the general contractor negligently failed to ensure the construction site was safe and that it failed to properly train its agents, employees and subcontractors. In her Motion for Summary Judgment, Voula argued that the general contractor was the Plaintiff’s statutory employer and that it was therefore immune from suit under the Pennsylvania Workers’ Compensation Act. Granting the Motion and entering summary judgment in favor of Voula’s client, the Court agreed that the record clearly established each of the five criteria required for the statutory employer defense, thereby making the general contractor immune from liability.
