TT&H Attorneys Marc Aoun and John Morgan Prevail on Termination and Claim Petition

TT&H attorneys Marc Aoun and John Morgan recently convinced an Altoona-area workers’ compensation judge to grant a termination petition and deny a claim petition in a heavily contested claim originally accepted as carpal tunnel syndrome. The litigation started when the employer’s medical expert found the claimant to be fully recovered in November 2021. Thereafter, the claimant attempted to expand the description of injury and allege a new work injury that occurred in August 2021. Marc presented several witnesses to highlight that Claimant did not mention anything about a new injury in 2021 at all. Marc also presented highly technical medical testimony showing that the original injury had fully resolved and did not include any additional upper extremity conditions.
Ultimately, the WCJ was convinced by the employer’s arguments and largely adopted the reasoning from the brief prepared by John Morgan in finding that the claimant and his medical expert were neither credible nor persuasive. This victory means that the employer may now pursue supersedeas fund recovery of nearly three years of medical and wage loss benefits paid over the duration of the litigation.
