TT&H Attorney Regina Parker Wins Termination of Benefits

Attorney Regina Parker recently won a termination of benefits and ruling that Claimant’s cervical spine surgery is unrelated to the work injury.
Claimant filed a Claim Petition for ongoing benefits alleging that he fell backwards from his truck and sustained cervical disc herniations, a strain/sprain, and an aggravation of underlying cervical degenerative disease that led to cervical spine discectomy and fusion.
The Pennsylvania Workers’ Compensation Judge (WCJ) granted the Claim Petition finding that Claimant sustained a cervical spine sprain/strain. However, the WCJ accepted Regina’s argument that Claimant was fully recovered and terminated benefits. The WCJ further found that the cervical spine surgery was unrelated to the work injury. Accordingly, the Claim Petition was granted for a limited period and the carrier was relieved of any ongoing benefits. Additionally, the carrier was relieved of liability for the discectomy and fusion.
