TT&H Attorneys Evan Jenkins and Lee Ann Rhodes Win on Termination Petition in Complex Brain Injury Case

TT&H attorneys Evan Jenkins and Lee Ann Rhodes prevailed on multiple petitions, most notably a Termination Petition, successfully arguing that the Claimant had fully recovered from a work-related concussion and traumatic brain injury. The Claimant used multiple medical expert witnesses, but the judge credited the Defendant’s neurologist, who had “superior” credentials. The judge also accepted the argument that Claimant’s expert was not credible, as she failed to convince the court that the Claimant remained disabled because of the work injury.

In addition to the termination, the arguments of Lee Ann and Evan allowed the carrier to recoup almost two years of overpaid benefits.
