TT&H Attorneys Jim Tinnyo, Burke McLemore and Regina Parker Present at Pennsylvania Bar Association WC Fall Section Meeting

On October 13-14, 2022, three TT&H Attorneys presented at the Workers’ Compensation Fall Section Meeting hosted by the Pennsylvania Bar Association. The Fall Section Meeting is an opportunity for adjusters and attorneys to stay current on new developments, significant cases, and judicial insights involving workers’ compensation law in Pennsylvania.
Jim Tinnyo presented “Litigating and Defending the Late Answer,” on a panel including Judge Michael Koll. The discussion touched on the impact of late answers, potential defenses in the case of a late answer, and commentary from Judge Koll on the judicial perspective of late answers and “Yellow Freight” motions made by Claimant’s counsel. Jim concentrated his discussion on how all is not lost in the event of a late answer, outlining what is and what is not admitted by a late answer, and litigation techniques to be utilized to maintain significant defenses to a claim petition.
Burke McLemore gave a presentation on “The 50th Anniversary of the National Commission on State Workmen’s Compensation Laws.” This presentation included a retrospective look at how workers’ compensation laws began in Pennsylvania, the state of the law coming into the 1972 Commission’s report, and how the report of the Commission has affected workers’ compensation laws since.
Regina Parker presented “Litigating Medical Bills,” on a panel including Judge Tina Maria Rago. The discussions touched on submission of medical bills, obligation to pay for medical treatment, the utilization review process, and case law updates. Regina provided an analysis from the defense perspective, including paying, challenging, and denying medical bills.
