TT&H Attorneys Marc Aoun and Cailey Farinaro Win Dismissal of Claim Petition Seeking Benefits for Alleged Work Injury Requiring Surgical Intervention

Marc Aoun and Cailey Farinaro of TT&H’s Allentown, Pennsylvania Office successfully defended a Claim Petition seeking medical and indemnity benefits for alleged work injuries in the nature of a lumbar disc herniation with an aggravation of lumbar spondylolisthesis, stenosis, and spondylosis requiring surgical intervention and resulting in chronic pain, nerve damage, and foot drop. The favorable defense verdict saved the employer current and future exposure of over $300,000.00 through at least two (2) more years of litigation.

Through the presentation of employer testimony, Marc proved to the workers’ compensation judge that the Claimant failed to report a work injury. Through medical testimony, he persuaded the judge that Claimant’s injuries were degenerative in nature and unrelated to the performance of her job duties. Cailey drafted the brief, therein highlighting the credibility of Defendant’s witnesses over the Claimant’s witnesses.
